Emma – Terms of Service & Privacy Notice

1. Introduction

Thank you for choosing Emma, an AI‑powered conversation tool designed to help you reflect on everyday thoughts and feelings. These Terms of Service (“Terms”) form a legally binding contract between you (“you” or “User”) and Borta Enterprises LLC. (“Emma”, “we”, “our” or “us”). By creating an account, clicking “I agree” or accessing the Service, you accept these Terms.

2. Eligibility

You must be at least 18 years old to create an account or use the Service. By registering, you confirm that you meet this requirement and that all registration information is accurate and kept up to date.

3. What Emma is & what Emma is not

No medical or diagnostic advice. Emma is an AI language model. It does not provide diagnosis, treatment plans, or professional mental‑health services. Always consult a licensed medical or mental‑health professional for personalised advice.
No crisis service. If you feel unsafe, think you may harm yourself or others, or are in an emergency, call your local emergency number (e.g. 911 in the U.S.) or contact a crisis hotline immediately.

4. Your Responsibilities

Maintain the confidentiality of your account credentials.
Use Emma only for lawful, personal purposes.
Do not input content that is illegal, harassing, or infringes the rights of others.

5. Subscription & Payments

New users receive a 3-day free trial. Unless canceled before the trial ends, the Individual plan is USD $20 per month and the Couples plan is USD $45 per month. Both plans renew automatically each month until canceled. Prices may change; we will notify you at least 30 days before the change takes effect for your next billing period. No refunds are provided except where required by law.

6. Data & Privacy Notice

Storage location. We store account data (e‑mail, hashed password, subscription status, chat transcripts) on secure servers located in the U.S.
Third‑party processing. Chat prompts, relevant recent recaps, and responses are sent to the OpenAI API to generate Emma’s replies, safety signals, and recap embeddings. OpenAI states that API inputs and outputs are not used to train its models by default; its standard abuse monitoring logs may retain customer content for up to 30 days unless a different approved data control or legal requirement applies. No data resale. We never sell your personal data.
Retention. Raw chat messages remain in the active service while a session is open and are removed after its recap is stored. Recaps and account records remain available until you delete your account; shared couple recaps are removed sooner when the partner link ends. Account deletion removes the remaining records from the active service; encrypted backups may retain the deleted records for up to 30 days unless a longer period is legally required.

7. Security

We employ encryption in transit and at rest. However, no system can be 100 % secure; you use Emma at your own risk.

8. Termination

You may cancel anytime from Settings → Manage Subscription. We may suspend or terminate your access if you breach these Terms.

9. Disclaimer & Limitation of Liability

Emma is provided “as‑is” and “as‑available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied. Our aggregate liability will not exceed the greater of (i) the amounts paid by you in the 3 months prior to the event giving rise to the claim, or (ii) USD $100.

10. Governing Law

These Terms are governed by the laws of the State of Connecticut, U.S.A., without regard to its conflict‑of‑law principles. Disputes shall be resolved in the state or federal courts located in Hartford, Connecticut.

11. Changes to These Terms

We may update these Terms; if changes are material we will notify you by e‑mail or in‑app at least 14 days before they take effect.
